Terms of Service
1. Acceptance of Terms
By accessing or using the TicketPress Kenya platform (the "Platform"), including creating an account, purchasing a ticket, or browsing event listings, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
These Terms constitute a legally binding agreement between you and TicketPress Kenya ("we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the Platform after any change constitutes acceptance of the updated Terms.
2. Our Services
TicketPress Kenya is an online ticketing platform that enables users to discover, purchase, and manage tickets to events across Kenya, including concerts, sports fixtures, comedy shows, festivals, and theatre productions. We also operate a secondary resale marketplace for eligible tickets.
We act as an agent for event organisers and do not own, operate, or control the events listed on the Platform. Event organisers are solely responsible for the events they list, including cancellations, postponements, and refund decisions.
3. Accounts & Registration
To purchase tickets or access certain features you must create an account. You agree to:
- Provide accurate, complete, and current information during registration
- Verify your email address before accessing purchase features
- Keep your password confidential and not share it with any third party
- Notify us immediately if you suspect unauthorised access to your account
- Be at least 18 years of age, or have the consent of a parent or guardian
You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Tickets & Purchases
All ticket sales are subject to availability. Once a purchase is confirmed and payment is successfully processed, you will receive a ticket confirmation by email containing a unique QR code. This QR code is your proof of entry and must be presented at the venue.
- One ticket per QR code. Each QR code is valid for a single entry. Duplicate or counterfeit tickets will be refused.
- Ticket limits. Maximum tickets per order are set per event tier. Purchasing beyond stated limits may result in cancellation of excess tickets without refund.
- Transferability. Tickets may be shared or gifted via the in-app share feature. Commercial resale outside the Platform's official Resale Marketplace is prohibited.
- Entry. Venues retain the right to refuse entry for reasons unrelated to ticket validity. TicketPress Kenya is not liable for venue entry decisions.
5. Payments & Refunds
All payments are processed in Kenya Shillings (KES) via M-Pesa. By initiating an M-Pesa payment you authorise Safaricom to debit your M-Pesa account for the specified amount.
Refund policy:
- Event cancellation. If an event is cancelled by the organiser, you are entitled to a full refund of the face value of your ticket. Refunds will be processed to your original M-Pesa number within 7–14 business days.
- Event postponement. If an event is postponed, your ticket remains valid for the new date. If the new date does not suit you, you may request a refund within 7 days of the postponement announcement.
- Buyer change of mind. We do not offer refunds or exchanges for purchased tickets unless the event is cancelled or postponed. All sales are final once confirmed.
- Failed payments. If your M-Pesa payment fails or times out, no charge is applied to your account. Retry the purchase or contact us if a charge was applied without a ticket being issued.
6. Resale Marketplace
The Platform operates a secondary ticket marketplace where verified ticket holders may list tickets for resale at or below the original face value. The following conditions apply:
- Sellers must hold a valid confirmed ticket to list it for resale
- A platform commission of 15% is deducted from the sale proceeds
- Resale proceeds are held in your Platform wallet and may be withdrawn via M-Pesa upon request
- Withdrawal requests are processed within 3–5 business days
- We reserve the right to remove listings or withhold proceeds if fraud is suspected
7. Acceptable Use
You agree not to use the Platform to:
- Scrape, harvest, or systematically collect data without our prior written consent
- Use automated tools (bots, scripts) to purchase or reserve tickets
- Sell or transfer tickets for commercial gain outside the official Resale Marketplace
- Create multiple accounts to circumvent ticket purchase limits
- Upload or transmit malicious code, viruses, or harmful content
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Engage in any activity that violates Kenyan law, including the Computer Misuse and Cybercrimes Act 2018
Violation of these rules may result in immediate account suspension, ticket cancellation without refund, and referral to law enforcement authorities.
8. Intellectual Property
All content on the Platform — including event listings, images, logos, software, and text — is the property of TicketPress Kenya or its licensors. You may not reproduce, distribute, or create derivative works from any Platform content without prior written permission.
Event images, artist names, and promotional materials remain the property of the respective event organisers and artists.
9. Limitation of Liability
To the fullest extent permitted by Kenyan law, TicketPress Kenya shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, including but not limited to loss of profits, loss of data, or event-related losses.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the specific ticket(s) giving rise to the claim.
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under Kenyan law.
10. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.
You may request deletion of your account at any time by contacting us. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.
11. Governing Law & Disputes
These Terms are governed by the laws of Kenya. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
